The China Competition Bulletin is a monthly publication from the China Competition Research Centre (CCRC). China Competition Bulletin: Edition 29, September/October 2013

In this edition of the China Competition Bulletin, we report on the conditional approval of MediaTek’s acquisition of MStar. The Ministry of Commerce (MOFCOM) imposed hold separate obligations, which was the fourth time it had done so since the Anti-Monopoly Law (AML) came into effect (previously hold separate obligations were imposed in Seagate/Samsung, Western Digital/Hitachi, and Marubeni/Gavilon). MOFCOM’s review of MediaTek/MStar took nearly 14 months (including the time period of the parties’ withdrawal and re-notification of the proposed transaction), making it the longest review period of a conditionally approved merger to date. The National Development and Reform Commission (NDRC) announced that it had conducted a nationwide investigation into pricing conduct in the tourism industry, which resulted in four enforcement actions in Hainan and Yunnan. The release of plans to restructure the domestic milk powder industry and reform the electricity industry is expected soon. Qihoo 360, a Chinese antivirus software provider, is active in the anti-monopoly arena again, this time being sued by Sogou, a Chinese search engine, and countersuing Sogou for alleged malicious tying conduct. We also report on the 1st International Symposium on Competition Law of Hunan University.
